C.R.M. (M) 1241 of 2025 In Re : An Application under Section 439 of the Code of Criminal Procedure/under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Debra Police Station Case No.
of dated 12.03.2025 under Sections 126(2)/70(1)/109/303(2)/351(2)/3(5) of the BNS. And In Re : Jishu Das @ Bubai Das Mr. Siddhartha Sarkar Mr. Akash Ghosh ... For the Petitioner.
Mr. Sanjoy Bardhan Ms. Srilekha Chattopadhyay ... For the State Md. Basir Layek ... For the Victim Learned counsel for the petitioner submits that the petitioner is in custody for more than 100 days. He has been falsely implicated. His further detention is not required. He prays for bail.
Learned counsel for the State opposes the prayer. I have considered the material on record.
The petitioner has been implicated by the victim lady. He has been identified in Test Identification parade. Some of the belongings of the victim have been recovered from the possession of the petitioner at his behest.
Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.
The application for bail is disposed of.
Case diary be returned.
Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
