The petitioner is in custody for more than five months and seeks parity with the co-accused who have been granted bail by this Court earlier.

Learned counsel for the State opposes the prayer. I have considered the material on record.

The petitioner has been implicated as one of the assailants by the eye witness to the incident. After rejection of his anticipatory bail, the petitioner absconded for more than a year before he surrendered before the learned trial Court. He does not appear to be similarly circumstanced with the co-accused who have been granted bail earlier.

Considering the material on record and prima facie role played by the petitioner in the alleged crime, prayer for bail is rejected at this stage.

The application for bail is disposed of.
