Learned senior advocate appearing for the petitioner submits that, the petitioner is in custody for about a year. Learned advocate appearing for the State submits that, narcotics of commercial quantity was seized from the possession of the petitioner.

Considering that nacotics of commercial quantity was seized from the possession of the petitioner, we are of the view that the petitioner is not in a position to overcome the restrictions under Section 37 of the NDPS Act, 1985. Consequently, we are not in a position to grant bail to the petitioner.

Accordingly, prayer for bail of the petitioner is rejected and the application being CRM 7601 of 2021 is dismissed. (Debangsu Basak, J.) (Bibhas Ranjan De, J.)
