Learned Advocate for the petitioner submits before this Court that the basis of implication of the present accused petitioner is the statement of a co-accused and thus, the present accused petitioner may be enlarged on bail.

While opposing the prayer for bail, learned Advocate for the State submits before this Court that the present accused petitioner is the kingpin of the racket which is revealed from the various materials in the case diary. He draws our attention to page nos. 44, 106 and 125 of the case diary (volume No. II). On perusal of the entire materials as placed before us, we find that the present accused petitioner being a cultivator deposited huge quantity of money through CSP (Customer Service Point) and there are statements of the witnesses with regard to the prima facie involvement of the present accused petitioner regarding procurement of the contraband articles from Manipur.

Considering the seriousness of the alleged offence, we are not inclined to allow the petitioner's prayer for bail. CRM (NDPS) 1146 of 2024 is, thus, dismissed.
