The petitioner is in custody for about three months and prays for bail.

Learned counsels for the defacto complainant and the State oppose the prayer.

I have considered the material on record.

The petitioner is the nephew of the victim. There appears to be a dispute among the family members. It is a fact that the complaint was lodged at a delay of more than one year. However, explanation of the delay has been given by the defacto complainant in her statement recorded under Section 161 of the Code of Criminal Procedure. This Court is informed that the family members of the petitioner are allegedly intimidating the wife of the victim for which a complaint has been lodged by her. Charge sheet has been submitted. The witnesses have implicated the petitioner in the alleged crime.

Considering the gravity of the offence and prima facie involvement of the petitioner therein, prayer for bail is rejected at this stage.

The application for bail is disposed of.
