The writ petitioner is aggrieved by the fact that the private respondents, who are the parties to Title Suit No. 07 of 2021 have violated an order of injunction passed by the learned Civil Judge (Senior Division) at Purulia.

An application under Order 39, Rule 2A of the Code of Civil Procedure has been filed in January, 2021 which has not yet been dealt with till date by the Court below.

The petitioner has not been able to explain as to why the steps have not been taken till date to seek early hearing of the application under Order 39, Rule 2A of the Code of Civil procedure.

Hence, reserving liberty to the petitioner to pray for such early hearing in the Court below.

The instant writ petition shall stand disposed of. There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
