The petitioner was an employee of the Calcutta State Transport Corporation (CSTC). The petitioner was superannuated from his service with effect from March 31, 2023. Within one month of his superannuation on April 26, 2023, the petitioner received 25% of his provident fund dues aggregating Rs. 9,27,000/-. The petitioner is aggrieved by the fact that remaining 75% aggregating Rs.27, 82, 206/- of his provident fund dues have not been disbursed till date.

Mr. Chatterjee, learned counsel appears on behalf of the petitioner.

Mr. Bihani, learned counsel appearing on behalf of CSTC submits that the petitioner is entitled to Rs.27,82,206/- being 75% of his provident fund dues.

In the light of the submissions made by the parties this Court directs a sum of Rs. 27,82,206/- to be paid to the petitioner within a period of three months from date of the order. The petitioner will be entitled to interest @6% per annum from April 1, 2023 (being the date subsequent to the date of his retirement) till the date of actual disbursal of the dues to the petitioner.

With the directions aforesaid, WPA 17397 of 2023 is disposed of.

Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
