The petitioner was an employee of the Calcutta State Transport Corporation (CSTC). The petitioner was superannuated from his service with effect from December 31, 2022. Within one month of his superannuation on January 1, 2023, the petitioner received 40% of his provident fund dues aggregating Rs. 6,67,000/-. The petitioner is aggrieved by the fact that remaining 60% aggregating Rs.10, 01, 345/- of his provident fund dues have been paid on July 31, 2023 after filing of the writ petition on July 18, 2023.
Mr. Chatterjee, learned counsel appears on behalf of the petitioner.
Mr. Bihani, learned counsel appears on behalf of CSTC.
In the light of the above discussions this Court finds that the petitioner is entitled to interest on the said sum of Rs.10,01,345/- from January 1, 2023 (being the date subsequent to the date of his retirement) till July 31, 2023 when the balance 60% of the provident fund dues were actually disbursed to the petitioner. Let such interest amount be disbursed within 3(three) months from date.
With the directions aforesaid, WPA 17402 of 2023 is disposed of.
Since affidavits have not been invited in the present writ petition, the allegations made in the writ petition are deemed not to have been admitted by the parties.
