The writ petitioner retired from service as an Assistant Teacher of South Duillya High School (H.S.), District - Howrah on 31st December, 2012.

The petitioner claims arrears of Provident Fund (own contribution) dues that were to be received on account of his service with South Duillya High School (H.S.), Sankrail, District - Howrah.

Counsel for the School submits that upon verification of account, the Teacher-in-charge has found that the petitioner has not received the balance 10% out of his aforesaid Provident Fund dues. A communication has been made to the District Inspector of Schools (SE), Howrah on 10th February, 2022, which remain unconsidered till date.

In those circumstances, this Court directs the District Inspector of Schools (SE), Howrah to take a decision on the release of the balance 10% of the aforesaid Provident Fund dues of the petitioner. Given the delay in release of the aforesaid 10% of the Provident Fund, the petitioner shall be entitled to and be paid interest from the date of retirement till the date of actual payment, at the rate of 9% per annum.

The instructions of the School dated 10th February, 2022 filed in Court today be taken on record.

With the aforesaid directions, the instant writ petition shall stand disposed of.

There will be no order as to costs.

All parties are directed to act on a server copy of this order duly downloaded from the official website of this Court.
