The writ petitioner claims that he had to leave his residence and stay away therefrom for a long period of time in view of threats of violence after the recent Assembly elections. The writ petitioner also submits that his house has been burnt and destroyed by miscreants. Counsel for the State submits that the place, which was burnt and damaged, was the office of a political party and not the petitioner's house.
Investigation was started which has resulted in Keshpur P.S. Charge Sheet No.217 of 2021 dated 28.08.2021 under Sections 143/427/436 of the Indian Penal Code. Three persons are stated to have been arrested. It is also stated that in respect of the complaint by the petitioner, Keshpur Police Station registered the case
being No. 116 of 2021 dated 16th June, 2021 and proceeding under Section 107 of the Cr. P. C. was started. It is also submitted that the writ petitioner is also an accused in Keshpur P. S. Case No. 88 of 2021 dated 1st April, 2021 under Sections 143/149/302/120B of the Indian Penal Code.
Counsel for the petitioner, however, submits that since after writ petition is filed, he is able to come back to residence and is living there.
There is, however, apprehension expressed by the petitioner.
In that view of the matter, the Officer-in-Charge, Keshpur Police Station shall maintain a regular vigil over the said premises and address any complaint by the petitioner immediately.
In the event, it is found that the residence of the writ petitioner has in fact been damaged the writ petitioner may apply to the concerned District Magistrate for compensation under appropriate provisions of Law and Rules of the government in this regard.
With the aforesaid observations, the writ petition is disposed of.
There will be no order as to costs.
