Mr. Partha Pratim Roy Mr. Sarbananda Sanyal ...... for the petitioner Mr. Puspendu Chakraborty ......... for IOCL The petitioner happens to be the sister of one Swapan Court No. 24 09.02.2022 (Item No. 144) (AB) Singha Roy who was the proprietor of a dealership under Indian Oil Corporation Limited. The said dealer died intestate on 1st May, 2021. He was a bachelor at the time of death.

The Indian Oil Corporation Limited by a communication dated 10th August, 2021 informed the heirs of the deceased dealer, including the petitioner, for reconstitution of the dealership in the prescribed format. According to the petitioner, the names mentioned in the communication dated 10th August, 2021 is not correct. The names of the persons who are not entitled under the succession law to inherit the property of the deceased unmarried males have been mentioned in the said letter. Learned advocate representing the Indian Oil Corporation Limited submits that it is open for the heirs of the deceased dealer to apply with their proposal for reconstitution of the dealership. If application is made by the heirs of the deceased dealer, then steps will be taken by them to consider the same in accordance with law.

In view of the submissions made hereinabove no further order is required to be passed in the present writ application.

It will be open for the heirs of the deceased to apply before the Company for re-constitution of dealership. In the event application is made, the same shall be considered by the Company strictly in accordance with law.

The writ petition is disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties after completion of all legal formalities.
