Ghosh ..for the State Mr. Gazi Farque Ms. Priyanka Mondao Ms. Chandra Paul ..for the respdt.4 The petitioner shall approach the panchayat authorities and apply for permission for construction of a brick wall in the prescribed format. The authorities shall take a decision, in accordance with law. If the permission can be granted upon the petitioner satisfying the requirements, the same shall be granted. A notice shall be issued to the respondent Nos. 6 to 9. If there are disputes with regard to the land in question and the respondent nos. 6 to 9 raise rival claims, a hearing shall be given to both the parties and a decision shall be taken.

The decision with reasons, shall be communicated to all.

It appears that the police authorities already kept a vigil in the locality, after receiving complaints of certain altercation which had been taken place over the dispute in question. The police authorities shall continue to maintain peace and tranquility.

The entire exercise shall be completed by the panchyat authorities, within a period of two months from the date of receipt of the application from the petitioners. .

This writ petition is disposed of.

There will be, however, no order as to costs. All parties are to act on the basis of the server copy of this order.
