Tanup Sarkar And Others v. State Of West Bengal And ANR
04.11.2024 jb.
jdt.
84 CRR No. 2960 of 2024 (CRAN 1 of 2024) In Re: Tanup Sarkar & Ors.
Ms. Puja Goswami ... For the Petitioners Ms. Rajnandini Das ... For the Opposite party Learned counsel for the petitioners and the private opposite party submit that the dispute has been amicably settled between the parties and the private opposite party does not intend to proceed with the matter any further.
It appears from the statement of the private opposite party/defacto complainant recorded under Section 164 of the Code of Criminal Procedure that the dispute between the parties has been amicably settled and she is living a happy and peaceful life with the petitioners in her matrimonial home.
In view of the above, this Court is inclined to hold that allowing the proceeding to continue shall be a futile exercise. Proceeding being SC 29(01) of 2024 pending before the learned Additional District Judge, Ranaghat, Nadia be quashed. The petitioners be set at liberty and discharged from their bail bonds.
The revisional application and the connected application being CRAN 1 of 2024 are disposed of.
Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities. (Suvra Ghosh, J.)
