Learned counsel for the State files a report, which is kept on record.

It is seen from the report that the State has taken a fair stand and disclosed all the vacant MIG flats within the complex, where the petitioner seeks shifting.

Upon query, learned counsel for the petitioner, on instruction, submits that his client is agreeable to move to Flat No. 1 in Block F on the ground floor. The specifications of the flat are "3BHK + 1 servant's room + two toilets", having a monthly rent of Rs. 700/-, as indicated in Serial No. 3 of the first chart disclosing the number of vacant flats in MIG, as shown in the report filed today.

Accordingly, WPA No. 17441 of 2023 is disposed of by directing the respondent no. 2, that is, the Estate Manager, Estate Directorate Ex-Officio, Deputy Secretary, Housing Department, to hand over the vacant possession of the said flat, as described as Serial No. 3 of the first chart of vacant MIG flats, to the petitioner at the earliest, positively within three weeks from date, by acting on a server copy of this order. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
