26.07.2023 Item No.267 Ct.No.34 Sayandeep C.R.R. 2706 of 2023 Ms. X being the victim Girl versus The State of West Bengal Mr. Avik Ghatak Mr. Aniruddha Bhattacharyya Mr. Uttam Mukherjee .......for the petitioner Mr. Saswata Gopal Mukherjee Mr. Imran Ali Mrs. Debjani Sahu ......for the State The petitioner is directed to serve a copy of the revisional application upon Mrs. Sahu, learned advocate who ordinarily appears on behalf of the State. Her appointment should be regularized by the concerned authority. Learned counsel appearing for the petitioner representing the victim submits that prosecution proposes to rely upon 28 witnesses. However till date only the examination-in-chief of the victim is over. Records reflect that Magrhat P.S. case No. 98 of 2021 was initiated on 12.04.2021.
Having regard to the sprit of the legislation and the fact that more than two years have passed in the meantime, I am of the view that the anxiety expressed by and on behalf of the victim is justified. Accordingly, the learned Special Court would fix a schedule of three dates and such schedule be fixed once in every 20 days, so that the Trial of the case
can be taken to its logical conclusion within a reasonable period of time.
The learned Trial Court would after being assured by learned Public Prosecutor fix such schedule if required, the superior officer of the police authorities may be directed to ensure regarding the production of the witness on the date so fixed. The learned Public prosecutor representing the State would produce the materials, documents and exhibits so required on the date fixed for a particular witness to be examined. All the stake holders would cooperate with the learned Trial Court so that the trial is concluded at the earliest.
With these observations, CRR 2706 of 2023 is disposed of.
Connected applications, if any, shall also disposed of accordingly.
