The writ petitioner is aggrieved by the interim recommendation and observations made by the West Bengal Commission for Protection of Child Rights in filing No. WBCPCR-22011(13)/19/2021 in a complaint between Aditya Deb and Smt. Debarati Deb (the writ petitioner).

The Chairperson of the Commission has given interim recommendations which the Counsel for the petitioner submits are outside the purview of Sections 13, 14 and 15 of The Commission for Protection of Child Rights Act, 2005.

This Court notes that the recommendations and observations of the Chairperson of the Commission are the interim and the final consideration is going to be taken up on 14th December, 2021. The parties have been notified accordingly.

It is only clarified that the recommendations shall be purely interim and interlocutory in nature. The final consideration shall be effected after due process under the Statute to be effected on 14th December, 2021 when the matter fixed for final consideration.

With the aforesaid observations, the instant writ petition shall stand disposed of.

There will be no order as to costs.
