Since the innocuous prayer of the petitioner is for expeditious disposal of GR Case No. 5692 of 2022 pending before the learned Chief Judicial Magistrate, Barasat, North 24 Parganas the matter may be disposed of without service of notice upon the opposite parties.

The opposite parties shall not be prejudiced by an order directing expeditious disposal of the case. This Court is informed that charge sheet was submitted before the learned Chief Judicial Magistrate on 13th July, 2023 and learned Magistrate directed issuance of notice upon accused persons/opposite parties fixing 5th September, 2023 for service return of notice. Since then no further date has been fixed by the learned Magistrate. In view of the above, the revisional application is disposed of directing learned Chief Judicial Magistrate, Barasat to take necessary steps for securing the attendance of the accused persons in the matter and fix dates for hearing the matter at regular intervals. The

learned Magistrate is also directed to dispose of the matter as expeditiously as possible without granting any unnecessary adjournment to either of the parties, in accordance with law.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
