Mrs. Shohini Chakraborty, Ms. Prajjaaini Das ...for the petitioners A direction to secure expeditious disposal of interlocutory application under Order 39 Rule 1 and 2 C.P.C. is the ultimate relief sought for in this case. Mrs. Chakraborty, learned advocate appearing for the petitioners submits that the petitioners have been suffering ad interim order of injunction since February 8, 2019. Objection to the injunction application has already been submitted, and the next date already scheduled by the court below is on 19th December, 2022.

No other point is raised requiring address by this Court.

In view of the nature of order proposed to be made in this case, no prior notice is considered to be necessary.

Service upon the opposite parties stands dispensed with.

Accordingly, learned Civil Judge (Junior Division) 1st Court, at Durgapur, Paschim Bardhaman in Title Suit No.33 of 2019, is requested to ensure expeditious disposal of the injunction application, providing sufficient opportunity of hearing to either of the parties to this case, subject to the suitability and convenience of the court below, without granting any unnecessary adjournment, unless it is extremely unavoidable, preferably before the end of March, 2023.

This would not, however, prevent the court below to take up the injunction application, if already scheduled on 19th December, 2022.

With this observation/direction the revisional application stands disposed of.

Petitioners are directed to make communication of this order to the learned court below as well as to the opposite parties and their learned advocate in the court below.

Urgent certified photostat copy of this order, if applied for, be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Subhasis Dasgupta, J.)
