Mr. Guha Thakurta, learned advocate representing the petitioner by relying on a communication dated 2nd August, 2023 submits that he has instruction to withdraw the present writ application. He, thus, prays for leave to withdraw the aforesaid application with liberty to file afresh. He further submits that the aforesaid prayer is being made since, the application has certain formal defects.

Having regard to the aforesaid, let WPA 17453 of 2023 be dismissed as withdrawn with liberty to file afresh on the selfsame cause of action.

Let a copy of the communication dated 2nd August, 2023 be retained with the records.

Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of necessary formalities.
