01.07.2022 serial no. 18-19 Dd CPAN 895 of 2021 in WPA 8686 of 2020 Techno Print Enterprise Vs.

Professor Minakshi Ray Mr. Tanmay Chowdhury, Advocate ... ... For the Petitioner Mr. Nilotpal Chatterjee, Mr. S. Banerjee, Advocates ... ... For the alleged contemnor The petitioner complains of violation of an order dated July 7, 2021.

By such order, the respondent no. 2 arrayed in the writ petition was directed to decide a representation in accordance with law.

It is contended on behalf of the alleged contemnor that the office of the respondent no. 2 is lying vacant for a considerable period of time by reason of which, the order could not be complied with. There is an application for modification of the order dated July 7, 2021 pending.

In the circumstances, I do not find that the authorities are in violation of the order dated July 7, 2021.

Consequently, I find no ground to exercise jurisdiction under Article 215 of the Constitution of India read with provisions of the Contempt of Courts Act, 1971.

This order will not prevent the parties from taking appropriate steps.

CPAN 895 of 2021 in WPA 8686 of 2020 is disposed of accordingly.
