The revisional application was preferred for transferring the case from the court of the learned Judicial Magistrate, Kalimpong, Darjeeling to the court of learned Magistragte, Jalpaiguri.

Record of this revisional application reflects that the matter appeared on 16. 08.2012 and 04.09.2012 when none appeared to represent the petitioner for presenting the revisional application.

Having regard to the fact that more than 9 years have passed since the revisional application was filed before this court and the issue was in respect of a transfer of the proceedings and no information have been furnished presently before this court regarding the stage of the case before the

jurisdictional court, I am of the view that no interference is called for by this court.

Accordingly, the present revisional application being CRR 2411 of 2012 is dismissed.

As the present case relates to police investigation and its consequences, Ms. Manisha Sharma, learned advocate appearing for the State is directed to assist the court. Her appointment may be regularized by the concerned authorities in due course.

All pending applications, if any, in connection with revisional application, are consequently disposed of. Interim order, if any, is hereby vacated.
