This revisional application challenges the order No. 58 dated 20th November, 2013 passed by learned Second Bench, City Civil Court, Calcutta in Misc Appeal No. 01 of 2008.

By the order impugned, learned Trial Court dismissed the application under Order 41 Rule 27 of the Code of Civil Procedure.

It is submitted that the appellant/tenant in respect of the suit premises surrendered the tenancy in favour of the LICI, the owner of the property. Consequent thereupon, this application has become infructuous.
