12.7.2023 Ct. No. 236 SB C.O. 1839 of 2014 In the matter of : Ramesh Kumar Kejriwal This revisional application under Article of Constitution of India was filed on 06.6.2014. None appears on behalf of either of the petitioner since after filing of this application. The impugned order was passed on 03.7.2013 when the prayer of the defendant no. 1 under Order 1 Rule 10(2) of Code of Civil Procedure was allowed and name of defendant no. 1 was struck off from the cause title of the suit. As in the suit for partition, defendant no. 1 stated that he did not have any right, title and interest over the property involved in the suit. By the later order learned Trial Court was pleased to reject the application under Section 10 of Code of Civil Procedure. Over the period of last ten years the matter appears to have lost its relevance.

None appeared since after filing of the petition for the petitioner. The application stands dismissed. Interim order of stay, if any, stands vacated. Let a copy of the order be sent to the learned Trial Court for information and necessary action.
