The revisional application was preferred challenging the proceedings pending before the Learned Judicial Magistrate 5th Court, Alipore, South 24 Parganas.

Record of the revisional application reflects that the interim order existed till November 19, 2012. Thereafter, the interim order was never extended. Today when the matter has been taken up, none was present to apprise regarding the present stage of the proceedings before the learned court below. Having regard to the contentions raised in the revisional application and the allegations made in the petition of complaint, I am of view that the complainant must be allowed to adduce his evidence before charge. As such no interference is required. Consequently, CRR 2426 of 2012 is dismissed Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
