CRIMINAL REVISIONAL JURISDICTION APPELLATE SIDE CRR 2095 of 2010 Re: Kalyan Kanti Panda None appears for the parties, despite receiving the administrative notice served upon them.

The instant revisional application has been filed for setting aside of the judgment and order dated 4th May, 2010, passed by the learned Additional Sessions Judge, Basirhat, District North 24 Parganas in Crijinal Refgision No. 42 of 2009, thereby affirming the order dated 6.11.2009, passed by the learned Judicial Magistrate, First Court at Basirhat in Case No. M-361 of 2008.

On perusal of the aforesaid order, this court finds that the court of learned Additional Sessions Judge, Basirhat has rightly observed that the powers of the revision as conferred by Sub. Section 1 of section 397 Cr.P.C shall not be exercised in relation to any interlocutory order passed in any appeal or other proceedings.

Under such circumstances, this court is not inclined to interfere with the impugned order. The instant revisional application is, thus, dismissed.

Let a copy of this order be communicated to the learned trial court for information and necessary action. ( Ananya Bandyopadhyay,J. )
