Affidavit of service is taken on record. Despite service none appears either on behalf of the Panchayat Authorities or on behalf of the respondent no. 14.
The petitioner has alleged that the respondent authorities are going to appoint the respondent no. 14 as an ASHA worker although the said respondent no. 14 does not belong to the sub-centre of Nawabpur Gram Panchayat, District - Hooghly, in respect of which the recruitment process has been initiated.
Without going into the merits of the claims and counterclaims of the parties, the writ petition is disposed of with a direction upon the Block Development Officer, Chanditala - I Development Block, Hooghly to dispose of the representation of the petitioner dated August 06, 2021 in accordance with law
upon hearing the petitioner as also the respondent nos. 13 and 14.
It is made clear that this order shall not be construed as an embargo in concluding the recruitment process, or an observation on the correctness of the allegation. The proceedings for recruitment shall not be stalled as the petitioner has not been able to show any document in support of her contention.
The entire exercise shall be completed within a period of four weeks from the date of communication of this order in view of the nature of the allegation involved. A reasoned order shall be passed and intimated to all concerned. The final selection shall abide by such decision of the Block Development officer.
The matter is being taken up even in the absence of respondent nos. 13 and 14 as no order is being passed which would be adverse to the interest of the said respondents. This writ petition is, thus, disposed of.
There will be no order as to costs.
All parties are to act on the basis of the server copy of this order.
