This is an application filed by the de facto complainant of GR Case No. 639/2006 for a direction of expeditious hearing of the above-mentioned case arising out of Contai Police Station Case No. 232/2006 dated 12th December, 2006 under Sections 420/468/471 of the Indian Penal Code presently pending before the learned Judicial Magistrate, 2nd Court at Contai.

It is submitted by the learned Advocate for the petitioner drawing my attention to a copy of the order passed by this Court in CRR No. 206/2009 that this Court directed the Trial Court to conclude the trial of the case within six months from the date of the said order. The said order was passed by a Coordinate Bench of this Court on 18th May, 2010. Thereafter more than 12 years have elapsed, but the

Trial Court was able to examine only four witnesses out of 12 witnesses.

Pendency of this case is a glaring example of non-compliance of the order passed by this Court for expeditious disposal. Under such circumstances, the learned Magistrate is specifically directed to examine the remaining witnesses as per the charge-sheet within four months from the date of this order positively and thereafter come to a logical conclusion of this case within one month. The direction made hereinabove is peremptory and mandatory and non-compliance of the above direction will be seriously viewed. The instant revision is, thus, disposed of.

The petitioner is at liberty to act on the server copy of the order.
