And In Re : Chandana Mandal Petitioner Mr. Ayan Bhattacharya ..For the Petitioner Mr. Bidyut Kumar Roy, Ms. Rita Datta ...For the State The present application for bail under Section 439 of the Code of Criminal Procedure has been preferred in connection with English Bazar Women Police Station Case No.152 of 2017 dated 24.07.2017 under Sections 6 & 14 of the Protection of Children from Sexual Offences Act, 2012 read with Sections 370/376D of the Indian Penal Code.

Mr. Bhattacharya, learned advocate appearing for the petitioner submits that the petitioner is languishing in custody for 1611 days and she has been falsely implicated. In the said conspectus, the petitioner may be enlarged on bail on any stringent condition.

Mr. Roy, learned advocate appearing for the State submits, upon instruction, that the matter has been fixed for argument. Records reveal that the petitioner's prayer was last rejected on 28th September, 2021. Considering the stage of the trial, we are

not inclined to grant bail to the petitioner and her prayer for bail is refused at this stage.

Accordingly, the application for bail, being CRM No. 7639 of 2021 is dismissed.
