On the prayer of Ms. Munmun Ganguly, learned advocate appearing for the State, time to file reports stands extended till today. The first report filed by the respondent no.5 in Court today, is taken on record. The second report filed by the respondent no.7 in Court today, is also taken on record.

Copies of these two reports are made over to Mr. Swapan Kumar Kar, learned advocate appearing for the petitioners, in Court today. On perusal of the reports and from the submissions made on behalf of the parties, it appears that the said land has already been utilised for public purpose by the State without completing the acquisition proceeding.

Such position has also been confirmed by the learned State counsel.

In view of the above, for the purpose of paying compensation to the actual land losers, the jurisdictional Special Land Acquisition Officer and the jurisdictional District Magistrate shall take all necessary and further steps to exercise the option under the Direct Purchase Policy in accordance with law and shall compensate the actual land losers following the due process of law.

The entire exercise as directed herein including the payment of compensation to the actual land losers shall be carried out and completed by the jurisdictional authorities positively within a period of eight months from the date of communication of this order.

Since affidavits are not called for, the allegations made in this writ petition are deemed not to have been admitted by the respondents. With the above observations and directions, this writ petition, WPA 18263 of 2024 stands disposed of, without any order as to costs. Photostat certified copy of this order, if applied for, be furnished expeditiously.
