Learned counsels for both the parties submit that after fighting long legal battle, ultimately good sense prevailed and the parties arrived at a joint terms of compromise. Accordingly, they have filed the present application being CAN 4 of 2023 and praying for disposing the present second appeal in terms of compromise petition. The terms mentioned in the compromise petition is legal and valid.

Accordingly, prayer is allowed. Let the second appeal being SAT 312 of 2012 is hereby decreed in terms of the compromise petition being CAN 4 of 2023. Let CAN 4 of 2023 be made part of the decree. SA 312 of 2012 along with CAN 4 of 2023 is accordingly disposed of.

Department is directed to draw up decree accordingly.
