September 28, 2022 Saunak Kumar Vs, Priyanka Dutta Kumar Mr. Ayan Banerjee, Ms. Debasree Dhamali, Ms. Riya Ghosh, ...for the appellant.

Mr. Rwitendra Banerjee, ...for the respondent.

In terms of the settlement arrived at before the learned Mediator, the parties on their own volition filed an application under Section 13B of the Hindu Marriage Act, 1955 before the learned District Judge at Barasat, North 24-Parganas, for dissolution of their marriage on mutual consent.

The learned District Judge at Barasat following the due procedure disposed of the Matrimonial Suit No. 2273 of 2022 by allowing the said application. A decree of divorce on mutual consent was accordingly passed by the learned District Judge on September 23, 2022. A copy of the said order is produced before us on behalf of the parties, let the same be taken on record. In terms of the said decree, the marriage solemnized between the parties on January 19, 2016 stood dissolved. Under such circumstances, nothing remains in the appeal and the same is disposed of by recording that the marriage solemnized between the parties stood dissolved by a decree of divorce on mutual consent. The impugned judgment is set aside.

There will be no order as to costs.
