Calcutta Electric Supply Corporation Limited and others Mr. Sujit Bhunia .... for the petitioner Mr. Debjit Mukherjee .... for the CESC Limited Learned counsel for the petitioner contends that the petitioner applied, as a co-owner of the property, for a new electricity connection which has not been given by the CESC Limited on the premise that the petitioner is required to produce certain documents such as:

 a certified site plan,  Deeds/partition deeds,  Municipal tax receipt,  Ownership documents It is contended that the petitioner is a co-sharer of the premises and has annexed to the writ petition documents of her occupation of the premises, including her voters' identity card etc.

Learned counsel for the CESC Limited, on instructions, submits that the CESC Limited is

agreeable to give a new electricity connection to the petitioner by way of a loop meter from the existing meter board position, subject to the petitioner complying with the formalities.

Such fair stand having been taken by the CESC Limited, WPA No. 17500 of 2023 is disposed of by directing the CESC Limited to give a new electricity connection by way of a loop meter from the existing meter board position at the premises-in-question to the petitioner, subject to the petitioner depositing the requisite amounts and complying with all formalities. However, while giving such connection, the CESC Limited shall not insist upon production of the documents as enumerated in the communication of the CESC Limited, annexed to the present writ petition.

Such connection shall be given by the CESC Limited within a week from the date of compliance of all formalities by the petitioner or from today, whichever is later.

The parties shall act on a server copy of this order.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
