Learned advocate representing the State respondents produces the instruction forwarded by the District Sub Registrar-IV, South 24 Parganas dated 18th June, 2025 which mentions that a deed of sale was presented for registration on 19th July, 2018 relying on a power of attorney given to Samir Halder.

The seller revoked the power of attorney by a registered deed on 19th July, 2018. The seller has made an objection before the District Sub Registrar mentioning that Samir Halder tried to transfer the plot of land in favour of his relatives with mala fide intention for undue advantage.

The petitioner prays for registration of the deed, which is pending since July 2018.

The Court is of the opinion that there are disputed issues involved in the instant writ petition. The civil rights of the parties qua the sale of the property sought to be registered, cannot be adjudicated either by the District Registrar or the writ Court.

It will be open for the parties to approach the competent forum for relief.

6.

No direction can be passed for registration of the disputed document.

7.

The writ petition stands dismissed.

8.

Copy of the instruction by the District Sub Registrar be handed over to the learned advocate for the petitioner.

9.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
