Hossain ... for the State - respondent(s) Mr. Tauhid Khan Mr. Kushal Chatterjee Mr. Atanu Haldar ... for the Private Respondent(s) The petitioner has approached this court being aggrieved by the inaction of the police authorities particularly the Officer-in-charge of Sankrail Police Station relating to steps not being taken for fraudulent and illegal sale of his property by way of impersonation.

The petitioner has also informed the superior office of police, but, inspite of the same, no steps were taken.

State has submitted a report which reflects that the police authorities

checked both the Sale Deeds and found that although, Mouza, JL Number and Dag Number are the same but, Khatian Numbers are different. Requisition, to that effect, has already been sent to the Additional District Sub-Registrar for clarification of the two Sale Deeds. The police authorities, as such, have taken steps. However, no case, till date, has been registered for investigation.

If the petitioner is aggrieved by the fact that any criminal case, till date, has not been registered, he would approach the jurisdictional Magistrate under the relevant provisions of law. The learned Magistrate would assess regarding the genuinity of the allegations, thereafter, pass necessary directions as he/she deems fit and proper.

Learned advocate for the private respondents is present and disputes and denies the allegations so made.

Having regard to the observations made above, further pendency of the writ petition is unwarranted.

With the aforesaid observations, WPA 17462 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
