...For the State Heard the submission of the prosecution as well as the defence counsel and peruse the case diary.

On careful perusal of materials on record it appears that the petitioner is not F.I.R. named accused and in course of investigation his name has revealed. However, charge-sheet has already been submitted. No specific overt act either from the F.I.R. or from the statement under section 161 of Cr.P.C. is found for which custodial interrogation is necessary. More so, as charge-sheet has been submitted no custodial interrogation is necessary.

Prayer for anticipatory bail is, therefore, allowed. Accordingly, in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs. 5,000/- with two sureties of like amount subject to the condition laid down in section 438(2) of the Bharatiya Nyaya Sanhita, 2023. The application for anticipatory bail is, thus, disposed of. Case Diary is, however, returned.
