Mr. Abhishek Banerjee ...for the State Learned advocate appearing for the petitioner submits that the husband of the petitioner was appointed as a Library Clerk at Ghatal Rabindra Satabarsiki Mahavidyalay, Paschim Medinipur.

Unfortunately, on November 23, 2007 he met with a road accident and went into coma for about twelve years. Ultimately, he died on June 14, 2019. The petitioner in the above circumstances made a representation before the Director of Public Instructions, West Bengal for release of the Death cum Terminal benefit and also for her family pension. The said representation has not yet been considered by the Director of Public Instructions. Learned advocate appearing for the college submits that the Principal of the College by a letter dated September 9, 2022 sought advice of the Director of Public Instructions for deciding the claim of the petitioner. Considering the facts and circumstances of the case, I dispose of the writ petition giving a direction upon the

Director of Public Instructions to take a decision with regard to release of terminal benefit and other benefits including family pension within a period of two months from the date of communication of this order. The Director of Public Instructions shall hear the petitioner as well as the college in arriving at his decision. The reasoned order should be communicated to the petitioner within one-week thereafter.

Accordingly, WPA 17517 of 2023 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
