1. In view of the innocuous nature of the prayer, no prior service of notice on the opposite parties is being directed.
2. Learned counsel for the petitioner points out that on September 3, 2019, this Court had passed a direction on the learned trial Judge to rehear and decide afresh the petitioner's repair application expeditiously. It is submitted that although the repair application has been decided, no effective order for making 'pucca' construction was passed in favour of the petitioner.
3. Learned counsel submits that as the suit is pending since the year 2009 and the petitioner is about eighty-nine years of age, as well as physically paralyzed, the suit may be directed to be decided early.
4. In view of the above circumstances, C. O.
No. 2557 of 2024 is disposed of by requesting the learned Civil Judge (Senior Division), Second Court at Diamond Harbour, District - South 24 Parganas, to dispose of Title Suit No. 188 of 2009, pending before the said court, along with pending applications, if any, as expeditiously as possible, positively within the month of December, 2025.
5. There will be no order as to costs.
6. The parties and all concerned shall act on the server copy of this order for the purpose of compliance without insisting upon prior production of the certified copy thereof.
