Petitioner is aggrieved by the inaction of the police authorities as the representation dated 06.07.2025 advanced to the Officer-in-Charge, Dankuni Police Station was not responded and no action was taken by the police authorities.

On the other hand, learned advocate appearing for the State has submitted a report. Report reflects that there is a land dispute existing for which Title Suit No.296 of 2025 is pending before the learned Civil Judge (Junior Division), 4th Court, Serampore, Hooghly.

According to the report submitted by the State, by an order dated 18.06.2025 there was a restraint order being passed so far as the suit property is concerned. So far as the issue relating to land is concerned, the civil court is already in seisin of the issue. If there has been a breach of the order passed by the civil court, it would be the civil

court to address the issue as substantial powers have been vested to the civil court to deal with the in consonance with law. If there is any violation of law and order, the police authorities would definitely handle the same with before hands. Petitioner, if he is aggrieved by the action of the police authorities, would approach before the learned jurisdictional Magistrate under the relevant provisions of law. The learned Magistrate would assess and ascertain regarding the nature of the allegations and thereafter pass necessary directions as he deems fit and proper. With the aforesaid observations, WPA 17609 of 2025 is disposed of.

There will be no order as to costs.

Report submitted by the State be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
