One order of the District Inspector of Schools has been filed before this court by the learned advocate for the State Mr. Biswabrata Basu Mallick, led by Mr. Raja Saha, learned advocate which I have perused and I find that this is a nicely written order wherein the District Inspector of Schools has concluded that the petitioner is eligible to get pensionary benefit as per rule. It is in page 3 of the said report.

Therefore, I direct the concerned District Inspector of Schools to send all papers to the Director of Pension Provident Fund and Group Insurance by two weeks from the date of communication of this order and the Director of Pension Provident Fund and Group

Insurance is directed to take steps for issuance of Pension Payment Order by six weeks from the date of receipt of the papers from the end of the District inspector of Schools. The Treasury Officer is directed to pay the pension including the arrear pension to the petitioner by four weeks thereafter. The above time period fixed by this court is mandatory and I hope and expect that this time period would be adhered to by the officers of the Government upon whom the order has been passed.

Learned advocate for the State has submitted that the petitioner was in custody for 133 days and such period of absence will not be counted in the length of service of the petitioner.

With this observation and direction, this writ application is disposed of.
