The present writ petition has been preferred primarily praying for expeditious disposal of the Miscellaneous Application being MA 994 of 2019 filed by the petitioner alleging violation of the order dated 4th April, 2018 passed in the original application (in short, OA), being OA 102 of 2018.

Mr. Manna, learned advocate appearing for the petitioner strenuously argues after the matter was last heard on 30th April, 2024, the next date of hearing has been fixed about ten months thereafter on 20th February, 2025 and as such, the petitioner is languishing before the learned Tribunal since the year 2018. The matter has been unnecessarily kept pending and in the said conspectus, necessary direction needs to be issued for speedy disposal upon preponing the date of hearing.

Mr. Dhar, learned advocate, enters appearance on the behalf of the State respondents.

The order dated 30th April, 2024 reveals that the matter was adjourned as time was prayed for by the petitioner for perusal of the compliance report filed by the concerned officer before the learned Tribunal. In the said conspectus, we do not find any justification or acceptable reason for issuing any direction for preponement and as such no interference is called for in the present writ petition.

It is, however, made clear that the learned Tribunal shall make a sincere endeavour to dispose of the Miscellaneous Application being M.A. 994 of 2019 filed by the petitioner alleging violation of the order dated 4th April, 2018 passed in OA 102 of 2018 which is pending since the year 2019, on the returnable date or preferably within a month thereafter, without granting any unnecessary adjournment to either of the parties.

The writ petition, being WPLRT 101 of 2024 is, accordingly, disposed of.

There shall, however, be no order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties, upon compliance of all requisite formalities.
