The petitioner is aggrieved by the inaction of the police authorities as in spite of informing the police authorities on 09.04.2025 relating to the illegal/illicit relationship, no steps have been taken by them.
The State has submitted a report. The report reflects that in so far as the present petitioner is concerned, there has been matrimonial dispute. To that effect, earlier criminal cases were registered in the year 2022 under the relevant provisions of law. Subsequently, on the basis of information furnished the police authorities have conducted an enquiry and found that the accusations could not be substantiated. Having considered that the police authorities prima facie did not find any material to proceed, the petitioner is granted liberty to approach the jurisdictional Magistrate under the relevant provisions of law. The jurisdictional Magistrate would then assess and ascertain further, the genuinity of the
accusation and pass necessary directions as it deems fit and proper.
With the aforesaid observations, WPA No. 17523 of 2025 stands disposed of.
Report submitted by the State be kept with the records. Copy of the report be handed over to the learned Advocate appearing for the petitioner.
