However, this order shall not prevent the appellant to take appropriate steps in accordance with law.

Accordingly, the second appeal stands dismissed as not maintainable.

In view of dismissal of the second appeal, the application also stands dismissed.

The original certified copy of the judgment shall be returned after retaining the Photostat copy of the same to the learned Advocate for the appellant in order to enable him to take immediate steps.

However, there shall be no order as to costs. 7.
