Heard learned Advocates appearing for the parties. By this writ petition, petitioner has challenged the impugned sale notice of the Co-operative Society in question, dated 29th July, 2022 which was going to be held on 5th of August, 2022 and petitioner is also aggrieved by the inaction on the part of the respondents authority concerned in considering and disposing of the petitioner's representation dated 2nd August, 2022 being Annexure P-3 to the writ petition. So far as the question of interference with the impugned auction notice is concerned, I am of the view that the same has become infructuous since it was not given effect to and petitioner could not have any cause of action at present against the same and so far as the

petitioner's aforesaid representation is concerned, the same shall be considered by the respondents concerned in accordance with law and by passing a reasoned and speaking order and after giving an opportunity of hearing to the petitioner or his authorised representative within eight weeks from the date of communication of this order.

With this observation and direction this writ petition being WPA 17923 of 2022 is disposed of. ( Md. Nizamuddin, J. )
