The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The opposite party on July 04, 2023 had suffered a decree of eviction in Title Suit No.949 of 2016 passed by the 4th Court of the learned Civil Judge (Junior Division), Howrah, aggrieved thereby the opposite party has preferred the Title Appeal No.94 of 2023 pending before the learned Additional District Judge, Fast Track Court-I at Howrah. The petitioner is complaining delay in disposal of the said appeal and is praying for a direction for expeditious disposal of it.

It appears from record that on several dates the appeal was posted for hearing but such hearing did not commence as the opposite party, the appellant of the said appeal had prayed for adjournment.

In view of the nature of the decree under appeal, the Appeal Court below is requested to make all endeavour to

dispose of the said appeal as expeditiously as possible in accordance with law and in doing so, shall not grant any unnecessary adjournment to either of the parties. C.O. 2561 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
