Learned layer for the State opposes the prayer for bail and submits statements of witnesses recorded under section 164 Cr.P.C show all the accused persons including the petitioner participated in the assault. Post mortem report discloses a number of injuries corroborating the ocular version of the witnesses. In view of the aforesaid circumstances and gravity of offence, we are not inclined to grant bail to the petitioner at this stage. Accordingly, the prayer for bail is rejected.
