Learned counsel for the petitioner submits that the padlock on the school/orphanage/closed school was broken open after informing the police and Durga Puja was held thereat this year.

Counsel for the State submits that the police were never informed of the same.

This Court had directed the parties on 9th September 2022 to establish rights and claims in the pending civil suit or any other civil proceedings. Steps were to be taken in accordance thereof.

Clearly the parties have taken the law into their hands.

Appropriate proceedings may be taken out by the parties in this regard as they may be advised.

Learned counsel for the State has produced a report in the form of instructions issued by the Officer-in-Charge, Usthi Police Station addressed to the learned Government Pleader and the same is taken on record.

The writ petition is disposed of without any further orders.

In view of the disposal of the main writ petition, CAN 1 of 2022, if any, shall also stand dismissed.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
