The instant application under Article 227 of the Constitution of India is at the instance of the plaintiff in a suit for partition and is directed against the Order No. 53 dated May 18, 2024 passed by the learned Civil Judge (Junior Division), Amta, District: Howrah in the said suit being Title Suit No. 9 of 2021.

The learned Trial Judge by the order impugned has dismissed an application filed by the plaintiff for local investigation of the suit property, holding inter alia that local inspections of the suit property have been conducted twice, and the reports of the learned Advocate Commissioner are already on record, as such, there is no need of holding local investigation again, particularly when the suit is at the stage of trial.

This Court does not find any reason to interfere with the order impugned.

C.O. 2564 of 2024 is therefore dismissed without any order as to costs.
