It is submitted by the learned Advocate for the petitioner that in the order dated 12th April, 2021, there is typographical error in Paragraph 2 of the said judgment where it is written, "it is not disputed by the petitioner that the opposite party is his legally married wife .....". According to the learned Advocate for the petitioner the word 'not' inadvertently recorded and it should be omitted.
I have heard the learned Advocate for the petitioner. The case of the petitioner is that the marriage between the petitioner with his wife was solemnized and subsequent to marriage he came to know that she was sulfuring from advance stage of cancer for 9 years prior to her marriage. Entire fact was recorded in the order dated 12th April, 2021. Solemnization of marriage was not disputed. Therefore, in Paragraph 2 of the
judgment is found to be correctly recorded and no portion of the said order amounts to clerical or ministerial error. Therefore, the prayer of the petitioner is rejected.
