In the writ petition order of Principal Secretary, Municipal Affairs Department, Government of West Bengal dated 17th January, 2014 is under challenge.

At the outset it has been submitted on behalf of the petitioners that out of nine writ petitioners petitioner No.4 has died.

Since the petitioners have made identical prayer of extending the benefit of the Government Order dated 23rd April, 2010 no further order need be passed on this writ petition as the issue has already been decided by this Court today in another writ petition being WPA 10176 of 2014 (Manab Chandra Ghosh & Ors. -vs- The State of West Bengal & Ors.) In view of the order passed in Manab Chandra Ghosh (supra) same direction is issued in this writ petition directing the Principal Secretary,

Municipal Affairs Department, Government of West Bengal to decide the claim of the petitioners to extend the benefit in terms of the Government Order dated 23rd April, 2010.

A copy of the order passed in Manab Chandra Ghosh (supra) duly countersigned by the Assistant Registrar (Court) be kept with the record of this writ petition.

Accordingly the order dated 17th January, 2014 stands set aside and present writ petition is disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
