This revisional application has been preferred seeking a direction upon FRIDAY COURT : MB-07 ITEM : AD-28 STATUS : DO BENCH ID : 266057 AR : NANDY the learned Additional Chief Judicial Magistrate, Bidhannagar, North 24-Parganas, to dispose of G.R. Case No. 422 of 2017 arising out of Bidhannagar East Police Station Case No. 57 of 2017 dated 24.05.2017 under Sections 428/429/504/506 of the Indian Penal Code, read with Section 11(k) of the Prevention of Cruelty to Animals Act, 1960. 2.

Learned Advocate appearing on behalf of the petitioner submits that based on a complaint, this case was initiated against the petitioner and another person way back in 2017. He submits that the charge-sheet was submitted in 2017; however, the charge was framed only in 2022, and the charge-sheet cites only five persons as witnesses. He further submits that although eight years have elapsed since the initiation of the proceedings, the trial has not yet been completed. He adds that the petitioner is an aged lady who has been subjected to such procedural rigmarole for the past eight years.

Having heard the learned Advocate appearing for the petitioner and upon perusal of the materials on record, I am of the view that there is no justification for keeping this revisional application pending. From the record, it is evident that the proceeding was initiated in 2017; however, eight years have elapsed and the trial has not yet been concluded. Moreover, only five witnesses have been cited in the charge-sheet. 4.

In view thereof, I find merit in the contention of the petitioner. 5.

The learned Additional Chief Judicial Magistrate, Bidhannagar, North 24-Parganas, is directed to dispose of G.R. Case No. 422 of 2017 arising out of Bidhannagar East Police Station Case No. 57 of 2017 dated 24.05.2017 as expeditiously as possible, preferably within a period of six months from the next date of hearing, i.e., 26.11.2025.
